Information on the Protection of Personal Data

INTRODUCTION

The security and/or protection of your personal data is a priority for * (“Company/Our Company”). With this awareness, we attach great importance to the processing and retention of all personal data related to individuals, including those who benefit from our products and services, in accordance with the Law on the Protection of Personal Data No. 6698 (“KVK Law”). In this regard, as the “Data Controller” as defined in the KVK Law and in accordance with the obligations set forth in Article 10 of the KVK Law and the Communiqué on Procedures and Principles to be Followed for the Fulfillment of the Obligation to Inform, published in the Official Gazette No. 30356 on March 10, 2018 (“Communiqué”), we are obliged to inform personal data owners about the processing of their personal data. In line with this obligation, we present this information regarding the identity of our Company, the purposes for which their personal data will be processed, the recipients and purposes of data transfers, the method and legal basis of data collection, and the rights granted to personal data owners under Article 11 of the KVK Law.

In this Privacy Notice, expressions such as “we” and “our” refer, unless explicitly stated otherwise, to Ferromagnet Electromagnetic Systems.

PERSONAL DATA

2.1. Definition of Personal Data

Under Article 3/I(d) of the KVK Law, “personal data” refers to any information relating to identified or identifiable natural persons. In this context, personal data includes any information related to an identifiable or identifiable natural person. For example, your name, surname, Turkish ID number, address, phone number, email address, date of birth, IP address you accessed, transaction details, etc., are considered personal data. In addition, according to the KVK Law, sensitive personal data includes information regarding a person’s race, ethnic origin, political opinion, philosophical belief, religion, sect, or other beliefs, clothing, membership in associations, foundations, trade unions, health, sexual life, criminal conviction, and security measures, as well as biometric and genetic data. Anonymous information or data anonymized or not linked to a specific person is not considered personal data under our company’s policy.

2.2. The Concept of Personal Data Processing

Under Article 3/I(e) of the KVK Law, the processing of personal data refers to any operation performed on personal data, such as obtaining, recording, storing, preserving, altering, rearranging, disclosing, transmitting, transferring, acquiring, making available, classifying, or preventing the use of personal data, either wholly or partially by automated or non-automated means as part of a data recording system.

SCOPE OF THE NOTIFICATION

3.1. Identity of the Data Controller

Under the KVK Law, the “Data Controller” is the natural or legal person who determines the purposes and means of processing personal data, and is responsible for the establishment and management of the data recording system. 3.2. Collection, Processing, and Purposes of Processing Personal Data

Your personal data is collected through various channels, such as offices, branches, distributors, call centers, websites, social media platforms, mobile applications, and similar means, either automatically or manually, as part of the services, products, or commercial activities provided by our Company.

In accordance with Articles 5.2 and 6.3 of the KVK Law, personal data can be processed without your explicit consent for the purpose of fulfilling legal obligations, entering into or performing a contract, establishing, exercising, or protecting legal rights, and ensuring legitimate interests, without infringing on your fundamental rights and freedoms. Furthermore, personal data can be processed upon obtaining your explicit consent, in accordance with Articles 5.1 and 6.2 of the KVK Law and the purposes outlined in this Privacy Notice.

The personal data we collect will be processed for the purposes of providing the products and services we offer, customizing the products and services to your preferences, usage habits, and needs, ensuring legal and commercial security, ensuring the physical security of company locations, conducting partner/customer/supplier evaluations, legal compliance processes, financial operations, determining and implementing our commercial and business strategies, and carrying out our human resources policies, all in accordance with the requirements and legal bases set out in Articles 5 and 6 of the KVK Law.

3.3. Transfer of Processed Personal Data to Domestic and/or Foreign Parties

The collected personal data may be transferred to authorized institutions and official bodies, as required by law or to fulfill legal obligations, to independent audit firms, tax consultants, external professionals, lawyers, insurance companies, partners, domestic and international third parties that provide services to the company, shareholders, business partners, suppliers, and relevant public and private entities, in accordance with the requirements and purposes of personal data processing specified in Articles 8 and 9 of the KVK Law.

Personal data may also be transferred to foreign countries that the KVK Authority has declared to have adequate protection or, in the absence of adequate protection, to countries where data controllers in Turkey and the relevant foreign country have undertaken adequate protection in writing, with the permission of the KVK Authority. Our Company will act in accordance with the provisions of Article 9 of the KVK Law and other relevant regulations.

3.4. Method and Legal Basis for Collecting Personal Data

Your personal data may be collected through written/digital applications from our employees, through our website, telephone calls, social media, SMS channels, and other verbal, written, or electronic means, either automatically or non-automatically, for the purposes of conducting our activities, fulfilling contractual and legal obligations, and maintaining communication with you.

The collected personal data will be stored in compliance with the relevant legislation for the duration specified in the applicable laws.

3.5. Rights of the Personal Data Owner Under Article 11 of the KVK Law

As personal data owners, you have the following rights under Article 11 of the KVK Law:

• If processed, to request information about it,
• To learn the purpose of processing your personal data and whether it is being used in accordance with the purpose,
• To be informed about the third parties to whom your personal data has been transferred, domestically or internationally,
• To request the correction of incorrect or incomplete data,
• To request the deletion or destruction of your data when the reasons for processing no longer exist,
• To request the notification of the corrections or deletions to third parties to whom the data has been transferred,
• To object to a decision made solely based on automated processing of your data, if it produces an unfavorable result,
• To request the compensation of damages in case your personal data is processed unlawfully and causes harm.
